1. Genetal provisions

1.1 These terms and conditions of sale (hereinafter - the Terms) determine the mutual rights. duties and responsibilities of the Buyer and UAB "Estrika" (Baltik Body Art) (hereinafter - the Seller) when the Buyer purchases good in the electronic store.

1.2 Product photos are for illustration purposes only, original products may differ from those shown. The specified photos cannot be used as a basis for claims. The product is considered high-quality if it corresponds to the example, model or description provided in the online store.

2. The moment of conclusion of the purchase and sale contract

2.1. The purchase and sale agreement between the Buyer and the seller is considered concluded from the moment when the buyer, after creating a shopping cart in the electronic store, specifying the delivey address, choosing the payment method and familiarizing him/her self with these conditions, click the "I confirm the order" button, and is valid until full obligations under this agreement execution.

2.2. Every contract between the buyer and the seller is protected.

3. Buyer's rights

3.1. The buyer has the right to buy goods in the electronic store in accordance with these Terms and the legal acts of the Republic of Lithuania.

3.2. The buyer has the right to withdraw from the contract of purchase and sale of goods withthe Seller by notifying the Seller in writing within 7 working days from the day of delivery of the goods, in accordance with the 2001 August 17 By order of the Minister of Economy of the Republic of Lithuania no. 258 " On approval of the rules for the sale of goods and the provisions of services when contracts are concluded using means of communication".

4. Responsibilities of the buyer

4.1. The buyer must accept the ordered goods and pay the price of goods and their delivery.

4.2. If the data provided in the Buyer's registration form changes, the Buyer must immediately inform the Seller.

4.3. The goods selected by the Buyer are reserved and the Seller undertakes to execute the sales contract only when the Seller receives a notification from the Buyer's bank about the payment for the selected goods.

4.4. The buyer must comply with the other requirements set out in the Terms and legal acts of the Republic of Lithuania.

5. Seller's rights

5.1. The Seller has rights  provided for in the legal acts of the Republic of Lithuania.

6. Resposibilities of the seller

6.1. To create conditions for the Buyer to properly use the services provided by the electronic store.

6.2. To organize the delivery of goods ordered by the Buyer to the address specified by the Buyer.

6.3. The seller, in case of important circumstances, being unable to deliver the ordered products of the Buyer, undertakes to offer the Buyer an analogous product, and if the Buyer refuses to accept the analogue of the product, to return the money paid by the Buyer within 5 working days. In this case, the Seller is released from responsibility for non-delivery of goods.

7. Delivery of goods

7.1. The goods are delivered at the expense of the Buyer by the transport company chosen by the Buyer when placing the order..

7.2. In Lithuania, Latvia and Estonia, the goods are delivered to the address specified by the Buyer within 3 working days from the receipt of payment for the goods and transportation of the goods. In other foreign countries, delivery of goods. In other foreign countries, delivery of goods may take up to 10 working days.

.7.4. The seller reserves the right to change the delivery price of the goods if the weight of the goods, the place of delivery or other circumstances affect it. In this case, the Seller contacts the Buyer and indicates the additional amount tobe paid for delivery. If the buyer refuses to pay this amount, the seller makes a refund for the order within 5 working days.

7.5. Upon noticing a damage of the shipment,  the Buyer must no accept the shipment and note this in the consignment note. if the buyer accepts the shipment and signs the consignment note without comments, it is considered that the deliverd shipments is without shipping damage.

8. Returning the goods

8.1. If the Buyer (user) refuses the contract of purchase and sale of goods, as provided for in clause 3.2 of the Terms and Conditions, the goods are returned at the expense of the Seller within 7 days of the Buyer's written notification of the cancellation of the contract of purchase and sale. Items, the shape, size, color, model or completeness of which the buyer (user) does not like (with the exception of the exceptions provided for in the legal acts of the Republic of Lithuania), are exchanged or accepted from the Buyer within 14 days from the delivery of the goods. Warranty maintenance - return of items is carried out in accordance with the 2001 June 29 By  order of the Minister of Economy of the Republic of Lithuania no. 217 "Regarding approval of the ruler for returning and exchanging items", the item is returned at the expense of the Buyer.

8.1.1.  The goods must be returned in the original product and shipment packagint (with instructions and warranty card, if it was provided with the product). The original invoice that comes with the product must be included with the return.

8.1.2.  The buyer is responsible for the assembly and packaging of the item. If the item is not complete and properly packed, the Seller will not accept the returned item.

8.1.3. Goods will not be accepted back if they have been used and/or have been damaged and/or have lost their commercial appearance (changes to the appearance of the product or its packaging, which were necessary to inspect the product, are not considered essential changes to the appearance of the product).

8.2. If the delivered product does not meet the quality requirements, the Buyer has the right to contact the Seller for repair or return of the product.

9. Responsibilities

9.1. The parties are responsible for the violation of the purchase and sale contract concluded using the electronical store in accordance with the procedure established by the legal acts of the Republic of Lithuania.

9.2. Taking into acoount Article 8 of the Electronic Signature Law of the Republic of Lithuania. on the 3rd provisions, the Buyer agrees with the Seller that the confirmation of the Buyer's actions in the electronic store with the login data to the electronic store (identification code) has Article 8 of the Electronic Signature Law.. 1d. established legal power of an electronic signature (i.e. has the same legal power as a signature in written documents and is admissible as a means of proof in court). The buyer must keep his login data to the online store and not diclose them, ensure that the data is known only to him/her and only he/she uses the data, not to transfer or otherwise enable other persons to get acquainted with or use the data. If there is a suspicion that the login data could have been obtained by another person, immediately notify the Seller about it, as well as immediately inform the Seller about the violation or disclosure of the login data to the electronic store. All actions performed using the Buyer's identification code are considered to be performed by the Buyer, and the Buyer assumes full responsibility for the consequences of such actions.

9.3. The seller is not responsible for the information provided on the websites of other companies.

9.4. In the event of damage, the guilty party compensates the other party for the losses incurred.

10. The correspondence of information (contact information)

10.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form..

10.2. The buyer sends all messages and questions to info@baltikbodyart.com

11. Final provisions

11.1. All disputes arising out of or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
